1. Definitions
- Company means ZUBERI LLC, legal address: 3 Irakli Parjiani St, Tbilisi, Georgia.
- Platform means the ZuBeri mobile apps for passengers and drivers, the website zuberi.ge and related services.
- User means an individual or legal entity ordering services through the Platform.
- Provider (driver, courier) means a person who has completed registration and moderation on the Platform and directly performs the order.
- Services means taxi, food delivery, courier delivery, vehicle towing and roadside assistance ordered through the Platform.
- Order means a User's request for a Service placed on the Platform.
2. Subject of the Agreement
2.1. The Company provides the User with access to the Platform and arranges for the Services to be performed by Providers, and also accepts payment for the Services, including by bank card.
2.2. The list of Services, service areas and fares are published on the Fares page and in the app. The price of a specific order is shown to the User before it is confirmed.
3. Registration and Account
3.1. To order Services, the User registers with a mobile phone number, verified by a one-time SMS code.
3.2. The User undertakes to provide accurate information and not to share access to the account with third parties. Any actions performed from the account are deemed to have been performed by the User.
3.3. The Services are intended for persons aged 18 or over. Minors may use the Services only when accompanied by, or with the consent of, a legal representative.
4. Placing and Fulfilment of Orders
4.1. The User specifies the pickup address (and destination), selects the type of Service, vehicle class and payment method. The Platform displays an estimated price.
4.2. An order is deemed accepted once a Provider has confirmed it in the app. The User can see the details of the Provider and the vehicle, and its location.
4.3. An order is deemed completed once the Provider has marked it as completed in the app (for taxi, after the passenger has been delivered to the destination; for delivery, after the item has been handed over to the recipient).
4.4. Free waiting time for the User at the pickup point is 3 min.; thereafter a waiting charge may apply according to the fare.
5. Price and Payment
5.1. The price is calculated according to the fares in effect at the time of the order and is stated in Georgian lari (GEL), inclusive of applicable taxes.
5.2. For taxi rides, the final price is determined by the actual route: pickup fee + kilometres + minutes, including surcharges for heavy traffic and bad weather, but not less than the minimum fare. The estimated and actual prices are saved in the order history.
5.3. Payment methods: Visa / Mastercard bank card or cash to the Provider. The method is selected for each order.
5.4. Card payments are processed through the payment gateway of JSC Bank of Georgia. When an order is placed, the estimated amount may be temporarily placed on hold on the card; after the order is completed, the actual price is charged and the remaining amount is released. 5.5. An electronic receipt is available in the order history in the app.
6. Cancellation and Refunds
6.1. Cancellation of an order by the User is free of charge until the Provider has marked their arrival at the pickup point. After the Provider has arrived, the cancellation fee is 3.00 ₾.
6.2. The procedure and timelines for refunds are set out in the Cancellation & Refund Policy, which forms an integral part of this agreement.
7. Rights and Obligations of the User
- to comply with the rules of conduct, the legislation of Georgia and the traffic rules insofar as they apply to passengers;
- not to carry or send prohibited or dangerous items and substances;
- to treat the vehicle with care; damage caused through the User's fault shall be compensated by the User;
- to pay for the Services in a timely manner;
- to contact support in the event of any dispute.
8. Rights and Obligations of the Company
- to ensure the operation of the Platform and 24/7 support;
- to allow only vetted Providers to perform orders;
- to review User requests within the established timeframes;
- to restrict or block an account in the event of a breach of this agreement, fraud or a threat to safety.
9. Liability
9.1. The parties are liable in accordance with the legislation of Georgia.
9.2. The Company is not liable for delays caused by force majeure, road conditions or actions of government authorities, or for failures of communication networks beyond the Company's control.
9.3. For food delivery, the selling establishment is responsible for the composition and quality of the dishes; the Company assists in resolving the claim.
10. Personal Data
Personal data are processed in accordance with the Privacy Policy and the Law of Georgia on Personal Data Protection.
11. Dispute Resolution
11.1. Claims shall be submitted to support via the app or to z.berishvili@gmail.com. The response time is up to 10 business days (up to 3 business days for payment matters).
11.2. Disputes not resolved through the claims procedure shall be settled by the courts of Georgia at the Company's place of business. The governing law is the legislation of Georgia.
12. Amendments
The Company may amend this agreement and the fares. A new version takes effect upon publication on the website; the User is notified in advance in the app of any material changes. Continued use of the Platform constitutes acceptance of the new version.
